As being stated, new policies, newly adopted laws will take effect since March 2020 in Vietnam with various improvements and suitable actions as follows:

Forced dismissal for traffic police harassment

Under Decree 19/2020/ND-CP, dated February 12, 2020, providing for the inspection and disciplining of law enforcement in handling administrative violations, officials and public employees who commit acts of violation will be subjected to disciplinary measures, including reprimand, warning, wage reduction, demotion, dismissal, and forced dismissal.

Accordingly, from the date of March 31, 2020, the time this Decree takes effect, the examination and disciplining will be conducted periodically in each locality, each region and each specialized branch. Discipline enforcement shall come into effect from July 1, 2020.

Based on the recommendations of the advising agencies, or based on the fact that obstacles, obstacles, difficulties and shortcomings have occurred in the handling of administrative violations, the heads of agencies with the function of law enforcement handling administrative violations will issue inspection decisions and set up inspection teams.

Credits for reformed prostitutes

Decision 02/2020/QD-TTg (Decision) became effective from March 1. Decision 02 extended the pilot credit program for households of HIV patients, rehabilitated drug abusers, reformed prostitutes in 15 provinces and cities by late December 15, 2020.

Under Decision 02, the loan maximum is VND 20 million with a duration of 36 months at preferential interest rate for poor households.

Main contents shown in undergraduate degrees

Circular No. 27/2019/TT-BGDDT stipulates main contents shown in undergraduate degrees and their annexes, coming into force from March 1, 2020.

Under the Circular, an undergraduate degree must contain the following information: Heading includes the official name and motto of Viet Nam; degree’s name specified according to training level (bachelor’s degree, master’s degree, doctoral degree or equivalent degree); field of study; name of the issuing educational institution; full name of the holder; date of birth of the holder; degree classification (if any); location and date of awarding the degree; title, signature and full name of the person authorized to confer and append the seal on the degree; serial number and reference number of the degree.

Hence, information about mode of study or degree classification is not compulsorily shown in an undergraduate degree.

Requirements for certifying Vietnamese nationality

Decree 16/2020/ND-CP shall take force from March 20 detailing a number of articles and measures to implement the Law on Vietnamese Nationality.

Decree 16 stipulated new provisions on the order and procedures for certification of Vietnamese nationality or Vietnamese origin about visa policy.

This new regulation contributes to help overseas Vietnamese to prove their Vietnamese origin or nationality through the confirmation of Vietnamese authorities before requests from competent agencies. These requirements not only contribute to creating conditions for expatriates to meet their essential needs, do business, invest, study, educate, get married but also help the competent authorities in Foreign countries have grounds to protect their lawful rights and interests when living abroad.

The certification of Vietnamese nationality or Vietnamese origin shall be carried out at the Department of Justice if he / she is residing in Viet Nam or a Vietnamese representative agency in the country of residence.

Fresh requirements for alcohol trading

Decree 17/2020/ND-CP, dated February 5, 2020 on amendments to some articles of decrees related to necessary business conditions in fields under the management of the Ministry of Industry and Trade.

Traders that produce spirits on industrial scale, traders that produce spirits for business purpose using traditional methods for business purpose, distributors, wholesalers and retailers of spirits having at least 5.5% alcohol by volume (ABV) are required to obtain a license.

Traders that trade in spirits having at least 5.5% ABV for on-premises consumption and traders that trade in spirits having less than 5.5% ABV are required to register their sale with the Office of Economics or district-level Office of Economics and Infrastructure; households and individuals that produce spirits having at least 5.5% ABV using traditional methods and sell them to holders of the spirit production license for re-preparation are required to register their production with the People’s Committees of communes where the production facilities are located./.
