Notable Policies Taking Effect from March 2026

Issuance of electronic identification codes for real estate

Decree No. 357/2025/NĐ-CP on the development and management of the information system and database on housing and the real estate market provides for the assignment of identification codes to real estate products.

Specifically, Decree No. 357/2025/NĐ-CP, promulgated on December 31, 2025, on the development and management of the information system and database on housing and the real estate market, sets out in Section II provisions on electronic identification codes and electronic identification accounts. Articles 8 through 12 stipulate various types of electronic identification codes, including: electronic identification codes for residential real estate products; electronic identification codes for real estate products comprising floor areas within construction works; electronic identification codes for condominium management and operation units; electronic identification codes for real estate brokerage practice certificates; and electronic identification codes for individuals entitled to housing support policies.

The electronic identification code for residential real estate products, as provided in Appendix I issued together with this Decree, consists of the following groups of information fields: land parcel identification code; project or construction work information code; location identification code (if any); and a sequence of natural characters.

The electronic identification code for residential real estate products is automatically generated within the information system and database on housing and the real estate market. The provincial Department of Construction is responsible for attaching the electronic identification code information to housing development projects within its jurisdiction at the same time as issuing the notification document confirming that the housing is eligible for sale as off-the-plan housing.

The Decree takes effect from March 1, 2026.

Online cancellation of permanent and temporary residence registration

The cancellation of permanent and temporary residence registration will be carried out entirely online under Decree No. 58/2026 starting from March 15, 2026.

Within one day from the date of receiving a decision to annul permanent residence registration issued by the immediate superior authority, or immediately after issuing a decision to annul a citizen’s permanent residence registration, the residence registration authority shall proceed to cancel the citizen’s permanent residence registration and update such cancellation in the Residence Database and the National Population Database.

The same time limit applies in cases where the National Population Database or the residence registration authority receives information reflecting that an individual falls under the cases subject to cancellation of permanent residence registration as prescribed at Points a and đ, Clause 1, Article 24 of the Law on Residence.

Within seven days from the date a household has a member subject to cancellation of permanent residence registration, such individual, the household representative, or the legal representative is responsible for carrying out the procedures for cancellation of permanent residence registration.

Citizens shall submit one set of application documents via the National Public Service Portal or the National Identification Application VNeID. The procedures for cancellation of temporary residence registration shall be conducted in a similar manner. Compared to previous regulations, citizens are no longer required to submit applications directly to the police authority or through public postal services.

Administrative violations in road activities subject to fines of up to VND 150 Million

The Government has promulgated Decree No. 336/2025/NĐ-CP providing for administrative sanctions in road activities, with a maximum fine of VND 150 million.

Decree No. 336/2025/NĐ-CP sets out provisions on acts constituting administrative violations; completed administrative violations and ongoing administrative violations; forms and levels of sanctions and remedial measures applicable to each violation; entities subject to sanctions; sanctioning authority and specific fine levels corresponding to each official title; authority to prepare administrative violation records; and the enforcement of administrative sanctions and remedial measures in road activities within the field of road traffic.

Under the Decree, the maximum monetary fine in road activities within the field of road traffic is VND 75 million for individuals and VND 150 million for organizations.

Specifically, violations of regulations on the use and exploitation of land allocated for road infrastructure are subject to fines ranging from VND 500,000 to VND 20 million.

Violations of regulations on the management, operation, exploitation, and maintenance of technical infrastructure works used jointly with road infrastructure are subject to fines ranging from VND 6 million to VND 15 million.

Fines ranging from VND 1 million to VND 20 million shall be imposed for violations of regulations on construction activities within the protection corridor of road infrastructure.

Violations of regulations on the management, exploitation, maintenance, and protection of road infrastructure are subject to fines ranging from VND 100,000 to VND 5 million.

Decree No. 336/2025/NĐ-CP takes effect from March 1, 2026.

Tightening digital banking security to reduce fraud risks

The State Bank of Vietnam has introduced stricter technical requirements for Online Banking and Mobile Banking services in accordance with international safety standards. This new regulation is set out in Circular No. 77 issued by the State Bank of Vietnam, which takes effect from March 1, 2026.

The new Circular imposes a series of more stringent technical requirements, focusing on protecting customers’ assets and preventing fraud in the digital environment. One notable provision is the enhancement of standards for detecting biometric spoofing. Accordingly, banks’ biometric authentication solutions must comply with ISO 30107 Level 2 international standards to counter increasingly sophisticated forms of impersonation, including those employing artificial intelligence. In addition, credit institutions are required to strictly manage the entire lifecycle of Mobile Banking applications.

Shortened procedures for establishing foreign representative offices

On February 13, 2026, the Government issued Decree No. 62/2026/NĐ-CP amending and supplementing a number of articles of Decree No. 06/2005/NĐ-CP on the establishment and operation of representative offices of foreign cooperation and research organizations in Vietnam. The Decree takes effect from March 1, 2026.

The Decree introduces the option of submitting applications online for the establishment of representative offices via the National Public Service Portal, in addition to direct submission or submission by postal service to the Ministry of Foreign Affairs. Within one working day from receipt of the application dossier, the competent authority must review its completeness and validity, request supplementation if necessary, and issue a receipt and appointment notice for the return of results if the dossier is valid.

The processing time has been reduced to a maximum of 14 working days, instead of 30 days as previously stipulated. In cases of refusal to grant a license, the Ministry of Foreign Affairs must respond in writing and clearly state the reasons.
